As a follow-up to my post yesterday, I began thinking deeper about the events of last week – the Supreme Court sanctioning gay marriage, upholding Obamacare and ruling that disparate impacts can be considered even if the wording of a law or regulation is not, on its face, discriminatory.Now, all three of these decisions are not your typical “the ICC’s ruling that the proposed merger of ABC corporation with XYZ corporation violates the terms of the Taft-Hartley Act is hereby overturned” or “Citizen Mary Doe was denied due process when she was arrested for mouthing off at a City Council meeting in Redux, Indiana, because she wasn’t advised of her Miranda rights.”No, the three rulings are pretty much tide-turning decisions that will have an impact on American society for a long, long time.

SUPREME COURT ASSOCIATE JUSTICE  CLARENCE THOMAS


My friends know how I view Justice Thomas and it’s not complimentary.I don’t like Scalia either.Both of them are diehard conservatives so it’s no biggie that I’m not a fan of either.But as an African American Justice of the Supreme Court and given his often outlandish dissenting opinions, Thomas does not get a pass from me.I admit that I am biased against Thomas and have been from the time when I sat through three or four days of painful Judiciary Committee Confirmation Hearings after he was cynically nominated by George Hebert Walker Bush, our 41st President, to the Supreme Court.Anita Hill charged Thomas with sexual harassment and all sorts of indecent remarks towards her and a host of weird activities with sexual overtones in her presence while employed at the Equal Employment Opportunity Commission (EEOC). Thomas was the EEOC’s director and Anita’s boss.

JUSTICE KENNEDY WRITES MAJORITY OPINION ON SAME SEX MARRIAGE



The Supreme Court today issued its opinion on the Obergefell vs. Hodges case (one of four before the Court) about whether or not states can ban same sex marriage and if one state must recognize legal same sex marriages performed in other states.A big day for gay and civil rights along the same lines as the decision in Loving vs. The Commonwealth of Virginia (1967) and Brown vs. Board of Education (1954). Justice Kennedy wrote the majority opinion in this 5-4 decision with the usual split on the bench we’ve seen time and again.I, personally, am grateful to Kennedy for his vote and for writing today's opinion.   He also wrote the majority opinions in two other landmark cases concerning gay rights: the 2003 ruling in Lawrence vs. The State Texas that struck down the criminalization of homosexuals and homosexual acts and the recent 2013 case of United Sates vs. Windsor that stuck down Congress’ ill-conceived, Defense of Marr…
